Under Georgia Code § 9-3-33, you generally have two years from the date of your injury to file a personal injury lawsuit. Wrongful death claims also have a two-year deadline. Missing these deadlines almost always forfeits your right to recover — don't wait, call us early so we can preserve evidence.
You can still recover damages in Georgia as long as you are less than 50% at fault — this is called modified comparative negligence. Your compensation is reduced by your share of fault. Even in our $18.75M MARTA verdict, the jury found our client 25% at fault and her family still recovered the largest verdict ever against MARTA.
Georgia law lets injury victims recover medical expenses (current and future), lost wages and loss of future earning capacity, property damage, pain and suffering, and mental anguish. In cases of gross negligence, punitive damages may also be awarded. We have recovered millions for clients, including a record $18.75M MARTA verdict.
